本文以財團法人法律規範、公私協力、臂距原則等相關理論,運用文獻分析 法考察四個政府捐助財團客家基金會之成立脈絡及捐助章程,所獲致之研究發現 為:客家事務機關與客家基金會間關係,若屬「人事分離」者,基金會具有「臂 距原則外部組織」性質;若屬「人事合一」者,基金會實已成為機關手足之延 伸。又,參照英國「臂距原則」實作發展,以及蘇格蘭「臂距原則外部組織」運 行經驗,本文建議可重新演繹臺灣依「臂距原則」所設立機構之價值,除「建立 中介組織以排除政治干預」功能外,應強化「公私協力」職能,以公部門、基金 會協力合作,提升公共政策之決策品質及執行效能。 | |
英文摘要 |
The essay employs the theory on foundations regulation, public-private partnerships, and arm’s-length as well as the research method of the literature review, to explore the four Hakka foundations. In terms of the personal institution between the Hakka agency and foundation, the essay finds that the foundations are the “arm’s length external organizations” (ALEO) when the personal institution is separate, and the foundations become the subordinate organizations of Hakka agency when the personal institution is merged. According to the UK’s experience of the “principle of arm’s length” and ALEO, the essay suggests that Taiwan could re-discover the value of ALEO, which are built via arm’s length. Besides establishing the intermediary organization to avoid political interference, ALEO should adopt the public-private partnerships to promote the quality of public policy. | |
